1. Agreement

These Terms and Conditions ("Terms") govern your use of Yacht Pier's yacht charter services and website located at https://yachtpier.com (the "Service") operated by Yacht Pier ("us", "we", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Booking and Reservations

2.1 Booking Process

All yacht charter bookings must be confirmed in writing and require a deposit to secure the reservation. Bookings are subject to availability and our approval.

2.2 Payment Terms

A deposit of 50% of the total charter fee is required at the time of booking. The remaining balance is due 14 days prior to the charter date. Payment can be made by credit card, bank transfer, or certified check.

2.3 Confirmation

Your booking is not confirmed until you receive written confirmation from Yacht Pier and the required deposit has been processed.

3. Cancellation Policy

3.1 Client Cancellations

  • Cancellations made 30+ days before charter: Full refund minus 10% processing fee
  • Cancellations made 15-29 days before charter: 50% refund
  • Cancellations made 7-14 days before charter: 25% refund
  • Cancellations made less than 7 days before charter: No refund

3.2 Weather Cancellations

If weather conditions are deemed unsafe by the captain, charters may be cancelled or postponed. In such cases, clients may reschedule without penalty or receive a full refund.

4. Safety and Conduct

4.1 Captain's Authority

The captain has absolute authority over the vessel and all persons aboard. The captain's decisions regarding safety, route, and conduct are final and must be respected by all guests.

4.2 Guest Responsibilities

Guests must:

  • Follow all safety instructions and wear provided safety equipment when required
  • Remain seated when the vessel is in motion unless permitted otherwise
  • Not bring illegal substances or exceed reasonable alcohol consumption
  • Respect the vessel, crew, and other guests
  • Provide accurate guest count and inform us of any special needs

5. Liability and Insurance

5.1 Limitation of Liability

Yacht Pier's liability is limited to the total amount paid for the charter service. We are not liable for indirect, incidental, or consequential damages.

5.2 Guest Responsibility

Guests participate in yacht charters at their own risk. Yacht Pier recommends that all guests obtain appropriate travel and medical insurance.

5.3 Damage to Vessel

Guests are responsible for any damage to the vessel caused by their negligence or misconduct. Additional charges may apply for cleaning or repairs.

6. Age and Health Requirements

All guests must be able to board and disembark the vessel safely. Minors must be accompanied by a responsible adult. Guests with medical conditions should consult their physician before participating in yacht activities.

7. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as outlined in our Privacy Policy.

8. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Yacht Pier and protected by copyright laws. Unauthorized use is prohibited.

9. Force Majeure

Yacht Pier is not liable for delays or cancellations caused by circumstances beyond our control, including but not limited to severe weather, mechanical failures, government actions, or acts of nature.

10. Governing Law

These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of any changes.

12. Google Ads Compliance

Yacht Pier adheres to all Google Ads policies and guidelines. Our advertising practices comply with applicable laws and regulations. We do not make unrealistic promises or use misleading language in our marketing materials.
